Mental Incapacity and Powers of Attorney

If a person suffers an accident or illness that means they can no longer make decisions for themselves, someone needs to step in to manage their affairs in their best interests.

If a person loses their mental capacity without having made a valid Enduring or Lasting Power of Attorney, then it will be necessary to apply to the Court of Protection for the appointment of a Deputy to manage that person’s affairs. This can be a complex and lengthy process, but our experts have considerable experience in this area and can guide you through it.

Making a Lasting Power of Attorney (“LPA”) while you still have capacity will make things much simpler for your friends or family should you ever lose mental capacity in the future. It also means that you can choose who will act on your behalf and in what circumstances, and it can also five them guidance to help them make decisions on your behalf. You can make an LPA to cover your property and financial affairs. If you wish, you can make one giving people you choose the power to make decisions regarding your personal welfare, guiding them in making those decisions should you be unable to make them for yourself.

Our knowledgeable team can advise you on the procedure required and can help you to draw up the LPA or LPAs that cover your needs, so that you can have the peace of mind that comes from knowing that your affairs will be properly dealt with in accordance with your wishes, should you ever be unable to deal with them yourself.

We charge for applications for the appointment of deputies on the basis of the time we spend working on your behalf. We are, however, happy to meet you free of charge to discuss your individual circumstances, at which time we would be able to advise you more fully on the costs.

We charge a fixed fee for LPAs. These start from £250 + VAT for preparing a LPA for a single person, or £350 + VAT for a couple. Please contact us so we can advise on our rates for your individual requirements.
