Regulation

FM&C Saffron Walden Solicitors and FM&C Haverhill Solicitors are trading names of Fairhurst Menuhin & Co ltd which is a Limited Liability company registered in England and Wales with number 7872324 and with VAT Number 163789564. Fairhurst Menuhin & Co ltd is regulated and authorised by the Solicitors Regulation Authority, firm number 598877. Where we refer to a ‘partner’ we refer to a Member of Fairhurst Menuhin & Co ltd.

Financial Conduct Authority

The provision of financial services is strictly regulated by the Financial Services Authority. FM&C is not regulated by the Financial Conduct Authority but, in common with all solicitors, the firm is permitted to give general financial advice arising in the course of our work as lawyers, where such advice qualifies as an “exempt regulated activity.”

We are not permitted to give advice on specific products or recommend to a client that he or she buy or sell specific rights and interests. Where such advice is needed you will need the advice of an Independent Financial Adviser (IFA) regulated by the Financial Conduct Authority. If you already have an IFA and you need financial advice, you should get in touch with them. If you do not have an IFA, we can put you in touch with someone who can advise you.

Law firms in the UK have had to adjust to seismic changes in the legal profession in the wake of the economic downturn and the increased level of regulatory controls imposed on law firms. The competition arising out of the proliferation of online ‘legal’ services has also made it necessary for the traditional high street practice to make deep-seated structural changes to its organisation. A vast number of high street law firms have not made these changes and are closing down at a rapid rate.

The opportunity to adapt to this changed environment has enabled our firm to acquire a leading edge by using sound business practice to support our legal services. Our use of technology and best business practice allows us to be customer-focus driven and able to offer the client the best advice across a range of different practice areas.

Our team brings together the strengths of both individuals with long-standing experience practising the law in this region, as well as individuals who have broad international expertise in business and the law. Our technical skills and local knowledge enable us to provide a professional service which combines an intimate knowledge of the local community and a personalised approach to providing legal services.

We work with our clients one-to-one and make it our business to fully understand their individual needs and circumstances. This ensures our clients can avoid frustrating and costly delays due to a lack of clear and timely communication. While keeping a close eye on costs, we are aware of the potential pitfalls of a careless or shortcut approach to legal services. We consider prevention better than a costly cure down the line.

What kind of Lawyer?

Our professional rules and regulations require us to inform our clients of the status of the lawyer dealing with their file. Our costs structure is based on qualifications and length of experience. Our team consists of:

Partners
The partners look after the interests of their clients, but are also responsible for running the business. As an Alternative Business Structure (ABS), FM&C are able to place experienced managers in partnership positions, bringing a wealth of business acumen to the provision of legal services.

Solicitors
Our solicitors are qualified lawyers who have undergone lengthy training involving a Bachelor of Laws (LL.B.) or conversion course and a further two years prior to qualification as a trainee solicitor. Solicitors are a separate profession from barristers (Counsel). We have an excellent relationship with local Chambers and happily work in collaboration with them when, for example, a case is complex or when it would be more cost-effective for a barrister to be instructed.

Legal Executives
A Fellow of the Institute of Legal Executives (“FILEX”) is a lawyer who has undergone a rigorous training very similar to that of a solicitor. The main difference is much of the training is done while working in a firm of solicitors, and the exams are spread over a period of years. A Member of the Institute of Legal Executives is a legal professional who has completed some of the exams required to be a FILEX, but who has yet to complete a further period of on-the-job training before attaining the full qualification.

Licensed Conveyancers
Licensed Conveyancers are a relatively new body of the legal profession. Like a FILEX, they train and complete their examinations while working at a firm of solicitors. Their expertise is focused on Conveyancing, Land Law, and related subjects. Licensed Conveyancers are entitled to practice independently, but they are not allowed to call themselves solicitors.

Paralegals
At FM&C, we have experienced paralegals who have done the job for many years. We charge for their services on a similar basis to a FILEX because we have every confidence in their ability to look after our clients. We also employ junior paralegals who are training on the job to become a FILEX.
